The Tahoe Regional Planning Agency administers some of the most restrictive land use regulation in the United States, and for a straightforward reason: everything that happens on the ground in the Tahoe Basin eventually reaches the lake. Fine sediment and nutrients carried by stormwater are the primary threat to Lake Tahoe’s clarity, and TRPA’s rules are built around limiting them.
For developers and property owners, that produces a review process that behaves differently from anything on the Nevada side of the hill. The critical work happens before design — and the answer to “what can I build here?” is often determined by a number that has nothing to do with your zoning.
Start with coverage, not with the building
Land coverage is the governing constraint on most Tahoe Basin projects. Before you think about the building, you need to know how much coverage the parcel is allowed and how much it already has.
TRPA defines land coverage as permanent land disturbance. It includes human-made structures — homes, driveways, parking lots — and, importantly, it also includes areas of compacted soil created by human use. That second category catches people out. A gravel parking area, a well-used dirt access track, a compacted equipment yard: these can count toward your coverage total even though nothing was ever built there.
The reason is hydrologic rather than legal. Compacted soil sheds water almost as readily as pavement does, and that runoff carries sediment toward the lake.
The Bailey system and capability classes
The land capability system in use derives from Bailey’s 1974 classification of the Lake Tahoe Basin. It applies to properties developed before July 1, 1987, and to all commercial and multi-family properties.
Each parcel carries a capability class, and each class carries a maximum base coverage:

Classes 1 through 3 prohibit new development. Classes 4 through 7 allow development with restricted coverage.
The practical implications are worth sitting with. A Class 4 parcel of one acre — roughly 43,560 square feet — permits about 8,700 square feet of total coverage at 20%. That figure has to absorb the building footprint, the driveway, the parking, the walkways, and any compacted areas. On a Class 3 parcel at 5%, the same acre yields around 2,200 square feet, which for most commercial programs is not a viable project without transferred coverage.
This is why the coverage calculation has to come first. A site plan developed without it is a site plan developed against an unknown budget.
IPES: how vacant parcels are evaluated
For vacant parcels evaluated after 1987, TRPA uses the Individual Parcel Evaluation System rather than fixed Bailey percentages.
IPES scores each parcel numerically across eight criteria and ranks parcels within each local jurisdiction by relative suitability for development. The weighting tells you what TRPA is actually protecting:
- Relative erosion hazard — up to 450 points, by far the heaviest factor
- Runoff potential — up to 200 points
- Stream environment zone impacts — up to 110 points
- Distance from Lake Tahoe — up to 50 points
Additional criteria address access, condition of the watershed, and related site characteristics.
Parcels receive building allocations as their rank reaches the threshold set for their jurisdiction. An IPES score is therefore not just a technical rating — it determines whether and when a vacant parcel can be developed at all. Scores of 725 and above also matter for BMP design, as described below.
Verifying what you actually have
Before design, you need TRPA to confirm the parcel’s status. The document depends on property type:
- Commercial and multi-family properties require a Land Capability Verification.
- Residential properties developed before 1987 require a Site Assessment.
These establish existing coverage and available coverage. Verification takes time, and it is the input every subsequent design decision depends on — so it belongs at the very front of the schedule, alongside your survey.
One caution worth stating plainly: exceeding your coverage allocation is a serious violation. Coverage found in excess during review typically has to be removed or mitigated, and discovering it late can compromise a project’s economics entirely. Existing conditions deserve careful measurement rather than an assumption based on what looks paved.
Coverage transfer and banking
Where a parcel does not have enough coverage for the intended program, additional coverage can often be acquired.
TRPA’s system allows development rights, including land coverage, to be transferred away from the most sensitive areas toward less sensitive parcels — the environmental logic being that retiring coverage on fragile land and relocating it to resilient land improves overall basin conditions. Updated policy provides flexibility for transferring coverage across the Region’s nine Hydrologically Related Areas.
In practice this is a market. Availability, price, and the specific rules governing what can move where all vary. If your project depends on transferred coverage, confirm what is actually obtainable before the site plan assumes it.
Best Management Practices
BMPs are the stormwater controls that keep sediment and nutrients on your site instead of in the lake, and they are effectively universal on Tahoe Basin projects.
The design approach depends on the project:
- Residential projects of four units or fewer, on high-capability or non-sensitive land — capability Class 4 through 7, or IPES of 725 or above — may use standardized BMPs with set dimensions.
- Larger projects, unusual site conditions, or projects on sensitive land — capability Class 1 through 3, or IPES below 725 — require BMPs designed specifically for the property.
For commercial and multi-family work, custom BMP design should be the planning assumption. These facilities occupy real space — infiltration areas, treatment systems, conveyance — and that space competes with the same coverage budget as everything else. BMPs designed after the site plan is fixed almost always cost more and work less well than BMPs designed alongside it.
What this means for your schedule
Tahoe Basin projects reward front-loading more than any other work we do. A workable sequence:
- Verify capability class or IPES score, and existing coverage, before meaningful design investment.
- Establish the coverage budget — allowable, existing, and available — and design the entire site to it, BMPs included.
- Resolve any coverage shortfall through transfer, or revise the program, before committing to a layout.
- Design BMPs concurrently with the site, not after it.
- Plan for review to take real time. Basin review is more involved than typical municipal review, and larger projects may trigger environmental review that extends the schedule considerably.
The projects that struggle are the ones that arrive with a finished design and ask whether it fits. The projects that succeed treat coverage as the first constraint and design inward from it.
